Hello Alan,

Thank you for writing to Windows Live Hotmail Customer Support. We are in receipt of three requests from you to activate your account. This is Chito and you mentioned that you could not access your account because it was closed. I understand how important it is for you to have clarification on this matter and for you to gain access to your account immediately. Our legal department has made a determination regarding your account. Let me assist you.

We are currently reviewing your Windows Live Hotmail accounts for any violation of our account policies. We have checked your red_finn@live.com account and have confirmed that you violated our Terms of Use (TOU) by attacking U.S. Senate candidate Al Franken on behalf of U.S. Senate Candidate Priscilla Lord Faris. We received a complaint from MNDFL Chair Brian Melendez requesting your e-mailing privileges be terminated in stating you e-mailed 62 people on the MNDFL SCC who do not want to receive your e-mails.

Even though you did violate our Terms of Use (TOU) in attacking U.S. Senate candidate Al Franken, we have reopened your account on a probationary basis and you should now be able to access it. Please try to log in and let us know if the problem persists. Your claim that we have violated your rights under the United States Constitution and Bill of Rights has no merit. Windows Live Hotmail has the right to determine what violates our Terms of Use (TOU).

In the past we have had to terminate your e-mail accounts for similar reasons after complaints from public officials and legitimate businesses. We will not allow you the use of our free services to carry out indiscriminate and unfounded attacks on public officials, businesses or the United States government. At present we have an investigation underway at the request of the United States Department of Justice to determine if an e-mailing you sent out is libelous and defamatory of the Federal Bureau of Investigation. Should we find you have violated our Terms of Use (TOU) your red_finn@live.com account will be permanently deactivated. Please be advised that your e-mail communications will be carefully monitored through electronic filtering and human monitors.

Here are a few valuable tips to ensure that your account never gets identified with a violation of our TOU:

. Check your contacts and recipients lists to make sure that only people who want to receive the messages will receive it.

. Reduce the number of messages that you send to large groups of people so that they are less likely to think your messages are unwanted e-mail.

. Limit the number of chain letters, e-mail jokes, and other messages that you send to help people recognize your e-mail as "wanted" and to make it more likely that your message will be allowed past your recipients' junk e-mail filters.

. Check all the contacts in your address book to make sure that the accounts are still active.

. If you are a commercial sender, you may want to review the content of our Windows Live Hotmail Postmaster Services site (http://postmaster.live.com) and sign up for programs that assist commercial senders.

Please accept my apology for the inconvenience. Thank you for understanding. Thank you for using Windows Live Hotmail.

Sincerely,

Chito M.
